Employed versus Self Employed

 
A recent court case has set a new precedent that working practices have more weight than contractual terms when considering whether an individual is employed or self employed.
 
Surprisingly the case was brought by car valeters, not by HMRC, who successfully argued they were employees and therefore eligible to employee rights, as their contracts did not reflect the actual working arrangements in place.
 
Revell Ward Tip:
 
Make sure that any contracts for services do reflect the reality of the working relationship.  Otherwise you could end up with an unwanted PAYE and NIC bill for contractors that you believe to be self employed.
