If an employer sets up a share scheme, such as EMI, there is a requirement to register the share scheme with HMRC and file an annual employment related securities (ERS) return each year.
An online return is required to be filed by 6 July following the end of the tax year, for each registered share scheme. So by 6 July 2017, for the tax year 2016/17.
If there are no reportable events during the tax year, a nil return is still required.
Before you can submit a return using the ERS Online Service you must be registered to use HMRC Online Services and PAYE online.
Penalties will be charged for returns filed late, and also for errors made it the return filed, if the reporting error results in a loss of tax.
